These Terms govern your use of SapotaCorp's website and services. Read them together with our Privacy Policy. By using SapotaCorp, you accept these Terms.
I. Definitions
- SapotaCorp ("we," "us"): the software engineering company at sapotacorp.vn, based in Đà Nẵng, Vietnam. Includes our affiliates and employees.
- You ("user"): the person or company using our website or services. You must be at least 13 years old.
- Service: our website and engineering work, including embedded engineers (staff augmentation) and fixed-scope projects.
- Subscription: an order for our Service that both parties accept, online or in writing.
- Subscription Date: the date you submit your order or sign a written agreement.
II. What we do
SapotaCorp provides software engineering for startups, SMEs, and product companies worldwide. We offer two engagement models:
- Embedded engineering: senior or mid-level engineers join your team and work as part of your product team.
- Fixed-scope projects: we deliver an agreed scope on an agreed timeline and price.
Features may change. By using the Service, you confirm you can enter this Agreement on behalf of yourself or your company.
III. Information we collect
We collect personal information to serve you, including:
- Name, email, phone, company, and other contact details.
- Country and preferred language.
- Website behavior and IP address.
- Other details you give us during conversations.
We may also collect data from third parties, but only with your consent.
IV. Information security
We sign Non-Disclosure Agreements (NDAs) before starting any project. The NDA covers:
- What counts as confidential information.
- How we store and protect it.
- How long the duty lasts.
- What happens if either side breaks the NDA.
- How we resolve disputes.
We back this up with restricted access, VPN connections, and a software approval process.
V. Engagement terms
1. Embedded engineering
Engineers work full-time on your project under your daily direction. We bill monthly based on each engineer's seniority tier. No minimum commitment. Either side may end the engagement with written notice.
2. Two-week trial
Every embedded engagement starts with a two-week trial. The engineer works full-time in your sprint at no cost.
If the fit is not right, you end the engagement with no fee, no deposit, no cancellation cost. We invoice only if you continue past the trial.
3. Fixed-scope projects
We deliver an agreed scope, timeline, and price. Payment milestones are in the Statement of Work. Scope, timeline, or price changes go through a written change order.
4. Intellectual property
Once you pay, all code, designs, and documentation we produce are yours.
Third-party components keep their original licences. We may reuse general know-how and skills we gain from the engagement.
5. Updates to this Agreement
We may update these Terms. We will tell you in advance. If you keep using the Service after the update takes effect, you accept the new Terms.
VI. Scope of services
We deliver engineering work across:
- Platform implementation (Salesforce, Microsoft Power Platform, Shopify).
- Internal tools and automation (Retool, Power Automate).
- AI integration and agent development (LLM integrations, RAG).
- Custom software development.
- Data engineering.
- QA and testing.
We deliver as embedded engineers or as fixed-scope projects.
VII. Governing law
These Terms are governed by the laws of Vietnam. We resolve any dispute first through good-faith negotiation. If that fails, the competent courts of Vietnam decide, unless we agree otherwise in writing.
VIII. Limitation of liability
Our total liability under any engagement is limited to the fees you paid us for that engagement in the three months before the claim.
We are not liable for indirect, incidental, or consequential damages. This applies to the fullest extent the law allows.
